FBRC.ai The Big Game Ad Challenge 2024 Official Rules

 

Participation in the FBRC.ai The Big Game Ad Challenge 2024 (hereafter referred to as "the Challenge") is not contingent upon any purchase or payment. 

 

The Challenge is accessible to individuals residing in any location where participation is legally permitted. To be eligible, participants must be at least 18 years old, or have attained the age of majority in their jurisdiction of residence if it is higher than 18, at the time of their entry. 

 

The Challenge is null and void in any jurisdiction where it is either legally restricted or prohibited.

 

1. **Sponsor**

   The Challenge is sponsored by FBRC.ai Holdings, Inc (hereinafter "Sponsor").

 

2. **Eligibility Criteria**

   - Eligible Participants: The Challenge is open to individuals from locations where the Challenge is legally permissible. Participants must be at least 18 years old or of the legal age of majority in their respective jurisdiction, whichever is higher, at the time of entry.The Challenge is not open to residents of Cuba, Iran, North Korea, Quebec, Russia, Syria, the Crimea, Donetsk People’s Republic, and Luhansk People’s Republic regions of the Ukraine, or any other jurisdiction where the Challenge would be restricted or prohibited by law.

   - Exclusions: Employees, representatives, agents, directors, and officers of the Sponsor, its parent entities, subsidiaries, affiliated companies, and marketing agencies, as well as those involved in the Challenge's administration (collectively, "Challenge Parties"), and their immediate family members (including spouses, parents, children, siblings, and their respective 'step' relatives) and household members, are not eligible to participate or win prizes in the Challenge.

   - Team Participation: Teams of eligible individuals can participate in the Challenge. Teams must designate one member as the team representative ("Captain") who will act on behalf of and enter the Challenge for the team. The individual entering on behalf of a team must have the necessary authorization to act as the team's representative and must confirm their authorization to submit the team's entry. If a team wins a prize, it will be awarded to the Captain, who will be responsible for the prize's distribution among team members.

   - Entry Limit: Each individual participant is limited to one entry in the Challenge.

 

By entering the Challenge, all participants (including any teams) agree to adhere to these official rules ("Official Rules") and accept the Sponsor's final decisions on all matters related to the Challenge.

 

3. **Challenge Participation Period**

The period for participating in the Challenge commences on Thursday, January 25, 2024, at 6:00:00 AM PST and concludes on Sunday, February 11, 2024, at 10:00:00 PM PST (referred to as the "Participation Period"). The official timekeeping for the Challenge will be managed by the Sponsor's computer system.

 

4. **Registration Process**

There is no requirement for purchase or payment, nor is it necessary to provide proof of purchase to participate in the Challenge.

 

To register within the Registration Period, participants must:

1. Fill out and submit the registration form available at FBRC.ai The Big Game Ad Challenge Website (https://fbrc.ai/thebiggame).

 

5. **Submission Procedure**

To submit an entry:

1. Create a video lasting under 1 minute that utilizes artificial intelligence tools (termed "Video Submission").

2. Fill out and submit the submission form located at FBRC.ai The Big Game Ad Challenge Website (https://woobox.com/6oudtg) ("Submission Form"). The form will require you to provide a link to your Video Submission and a brief description of the AI techniques employed in your Video Submission.

 

The Sponsor, at its sole discretion, will determine compliance with entry requirements. Once submitted, neither the Video Submission nor the Submission Form can be altered.

 

6. **Submission Guidelines**

In submitting your Video Submission and participating in the Challenge, you (or your Team) affirm and guarantee that:

 

1. You (or your Team) hold all necessary rights to the Video Submission, including rights to all content, trademarks, artwork, text, and music featured in it. Furthermore, you (or your Team) possess the authority to grant the Sponsor the rights to use the Video Submission as outlined in these Official Rules.

   

2. The use of your Video Submission in accordance with these Official Rules does not obligate the Sponsor or any third parties to make any payments or royalties to either the Team or any other third parties.

 

3. Your (or your Team’s) Video Submission:

   a. Is original to you (or your Team), has not been previously submitted in other events, film festivals, or competitions, and was created entirely within the Challenge Participation Period.

   b. Does not infringe upon or violate any other party's rights, including privacy, publicity, copyright, trademark, trade secret, trade dress, patent, or other intellectual property rights.

   c. Does not disparage the Sponsor, any party affiliated with the Challenge's promotion and administration, or their products or services.

   d. Is devoid of indecent, lewd, pornographic, obscene, profane, hateful, defamatory, slanderous or libelous material, and does not promote substances or activities like alcohol, illegal drugs, tobacco, firearms/weapons, or violence, illegal conduct, or animal cruelty.

   e. Avoids promoting discrimination or contempt based on race, ethnicity, national origin, caste, sexual orientation, gender, gender identity, religious affiliation, age, disability, or serious disease.

   f. Is free of viruses, trojan horses, trap doors, back doors, easter eggs, worms, time bombs, cancelbots or other harmful computer programming routines.

   g. Is suitable for a general audience.

   h. Does not contain any unlawful material in any jurisdiction where it was created.

 

Submissions that fail to meet these guidelines, as determined by the Sponsor in its sole discretion, or do not adhere to the entry deadlines, will be disqualified. By submitting the Video Submission and participating in the Challenge, you (and your Team) agree to indemnify and absolve the Challenge Parties from any and all claims, demands, causes of action, and judgments (including legal fees, court costs, and expert fees) arising from or related to any violation of the above representations and warranties by you (or your Team).

 

 

7. **Selection and Notification of Winners**

The Sponsor will announce the finalist Video Submissions around February 13, 2024, and these submissions will be open for public voting from 6:00 AM PST on February 13, 2024, until 11:59 PM PST on February 16, 2024 ("Voting Period"). The official timekeeping for the Challenge is managed by the Sponsor's computer. The number of finalists is at the sole discretion of the Sponsor.

 

Winners are subject to verification of eligibility, including age and residency. Winners may need to complete, sign, notarize, and return documents for eligibility/liability release, publicity release, and other related documentation.

 

If a Winner is deemed ineligible, does not respond within 48 hours of the first notification, or fails to provide requested information or documents, they will forfeit their prize. The Sponsor may then select an alternative Winner or choose not to award the unclaimed prize(s).

 

8. **Prizes and Claiming Prizes**

Prizes are non-transferable and no cash or other substitutions are permitted, except by the Sponsor's discretion. If a prize is unavailable, the Sponsor reserves the right to substitute a prize of equal or greater value.

 

Winners are responsible for all taxes associated with prize receipt and use. Winners must provide a valid social security number or other necessary information for tax reporting. The Sponsor may withhold a portion of the prize value for tax compliance.

 

Winners bear all expenses related to prize acceptance and use not explicitly provided for in the rules.

 

9. **Publicity**

Unless prohibited by law, accepting a prize grants the Sponsor and its agents the right to use the Winners' names and prize information for advertising and marketing without additional consent or compensation. Winners may be required to sign an affidavit of eligibility, liability/publicity release ("Affidavit and Release"). Failure to return these documents in time may result in prize forfeiture.

 

10. **Rights to Video Submissions**

By entering, participants grant the Sponsor a non-exclusive, perpetual, worldwide, royalty-free right and license to use the Video Submission. The Sponsor may modify the Video Submission as needed. Participants retain ownership but waive moral rights to the Video Submission.

 

11. **Limitations of Liability**

Participants agree that the Challenge Parties are not liable for indirect, incidental, consequential, punitive, or special damages related to the Challenge or any prizes. Participants limit their remedies to out-of-pocket expenses for participating in the Challenge.

 

The Challenge Parties are not responsible for any Claims arising from Challenge participation or prize receipt/use. Sponsor may modify these rules to correct errors or ambiguities. Only the stated number of prizes will be awarded.

 

Legal actions to undermine the Challenge may result in damages and other legal consequences.

 

The Sponsor reserves the right to disqualify any participant or their associated team from the Challenge and prize eligibility if, at its sole discretion, it finds that the participant is engaging in unfair practices such as cheating, deception, using automated entry programs, or if they are trying to disrupt the Challenge or harass other participants or the Challenge Parties.

 

For residents of California: You agree to waive the rights granted by California Civil Code Section 1542, which states that a general release does not cover claims unknown to the releaser at the time of releasing that, if known, would have materially affected the decision to agree to the release.

 

12. **Sponsor's Right to Modify**

If external factors beyond the Sponsor's control, including but not limited to force majeure events, computer viruses, tampering, unauthorized intervention, fraud, technical failures, government orders, natural disasters, or pandemic effects, prevent the Challenge from running as planned, the Sponsor retains the right to alter, suspend, or cancel the Challenge. In case of cancellation, the Sponsor may choose winners from all eligible, non-suspect entries received before the cancellation.

 

13. **Governing Law**

Issues regarding the interpretation and enforceability of these Official Rules, as well as rights and obligations of participants and the Sponsor, will be governed by California law, excluding its conflict of law principles. Disputes will be exclusively resolved in Los Angeles, California courts. Non-enforcement of any Official Rules term by the Sponsor does not constitute a waiver. If any rule is found invalid or unenforceable, it will be omitted, and remaining rules will remain in effect.

 

14. **Privacy**

Personal information collected from participants during the Challenge will be used by the Sponsor and its agents solely for Challenge administration and fulfillment.

 

15. **Winners List**

To request a list of Winners, email lab@fbrc.ai with the subject line “FBRC.ai The Big Game Ad Challenge 2024 - Winners’ List” within 60 days after the Winners are announced.
